Ownership of Rights

All intellectual property, including but not limited to trademarks, website, brand names, logos, product designs, photographs, packaging, lookbooks, written content, and marketing materials is and shall remain the exclusive property of Valesi.

No purchase, browsing, or participation in promotions shall be construed as granting you any right, license, or interest in these assets. Your use of Valesi products is strictly limited to personal, non-commercial purposes.

Any commercial use, reproduction, distribution, adaptation, resale, or modification of Valesi’s intellectual property, in whole or in part, without the prior written consent of Valesi pursuant to express negotiations and agreement, is strictly prohibited and shall attract immediate legal recourse, including civil and/or criminal remedies, at the sole discretion of Valesi.

Moral & Personality Rights

In addition to intellectual property protections, all moral rights, personality rights, brand identity, trade dress, goodwill, and reputation associated with Valesi remain vested exclusively in Valesi.

No individual, customer, collaborator, or third party is permitted to use, imitate, misrepresent, or exploit the name, likeness, style, persona, or brand identity of Valesi, whether for endorsement, publicity, promotional activity, or commercial gain, without the express prior written consent of Valesi.

Any unauthorized association or suggestion of affiliation, sponsorship, or endorsement with Valesi is strictly prohibited and shall entitle Valesi to pursue injunctive relief, damages, and other legal remedies under applicable law.

Liability for Third-Party Misuse

Valesi exercises all reasonable care to protect and enforce its intellectual property. However, Valesi shall not be held responsible or liable for any unauthorized use, counterfeiting, imitation, or misrepresentation of its brand assets by third parties outside its control.

We encourage customers, collaborators, and the public to promptly report any suspected misuse or infringement to Valesi so that appropriate legal or corrective action may be initiated.

Influencer Collaborations & Compliance

All promotional and influencer collaborations conducted by Valesi are undertaken in strict compliance with the Advertising Standards Council of India (ASCI) Guidelines, Consumer Protection Act, 2019, and the Consumer Protection (E-commerce) Rules, 2020.

Influencers and collaborators act in their individual capacity, and their personal views do not constitute binding endorsements, representations, or warranties by Valesi.

Consent, Binding Effect & Jurisdiction

By purchasing Valesi products, browsing or engaging with our website, social media platforms, community platforms (including but not limited to Instagram, Facebook, LinkedIn, and any other channels through which we may communicate), or accessing our brand through any online or offline medium, you confirm that you have read, understood, and agreed to be bound by this Intellectual Property Policy, together with our Terms & Conditions and all other legal disclaimers published on our website.

Valesi maintains a zero-tolerance approach to the misuse of its intellectual property or violation of this Policy. Accordingly, Valesi expressly reserves the right to:

• Suspend or restrict access to its website, services, or community platforms;
  

• Terminate or withdraw participation in promotions, campaigns, or influencer collaborations;
  

• Pursue civil and/or criminal proceedings, including injunctive relief, damages, and any other remedies available under applicable law.
  
  

Governing Law & Jurisdiction:
This Policy shall be governed by and construed in accordance with the laws of India. Any dispute, claim, or proceeding arising from or in connection with this Policy shall be subject to the exclusive jurisdiction of the courts at Delhi, India.
